The EcomIQ products and the website at ecomiq.tools (together, the “Services”) are operated by:
PBF Piotr Białozor-Fiećko — a sole proprietorship registered in Poland, trading as EcomIQul. Józefa Chełmońskiego 12, 14-200 Iława, Poland
NIP: PL8461552859
Email: support@ecomiq.tools
In these Terms, “EcomIQ”, “we”, “us”, and “our” refer to PBF Piotr Białozor-Fiećko. “You” refers to the merchant, business, or individual using the Services.
2. Acceptance of these Terms
By installing, accessing, or using any EcomIQ product, you agree to these Terms. If you use the Services on behalf of a business, you represent that you are authorized to bind that business. If you do not agree, do not use the Services. Product order pages or in-app terms, where they exist, form part of these Terms.
3. The services
EcomIQ provides a suite of tools for Shopify merchants:
- CollectionsIQ — a Shopify app that builds and maintains dynamic product collections driven by advertising performance and sales data.
- PixelIQ — a free Chrome browser extension that helps you debug Shopify web pixels. It is also subject to the Google Chrome Web Store terms.
- TestIQ — a demand-testing tool (in development).
We may add, change, or discontinue features. The Services are provided on a software-as-a-service and software-tool basis; you remain responsible for your own store, content, advertising, and compliance.
4. Eligibility
The Services are intended for businesses and for individuals aged 18 or over acting in a business capacity. They are not directed to children. You must comply with all laws applicable to your use, including those of the markets in which you sell.
5. Accounts & installation
CollectionsIQ is installed through your Shopify admin and authorized using Shopify’s permission flow. PixelIQ is installed from the Chrome Web Store. You are responsible for the security of your store, browser, and connected accounts, and for all activity through them. You may connect third-party advertising accounts (e.g. Google Ads, Meta, Pinterest, TikTok) that you control; you authorize us to access them on a read-only basis to provide the features you enable.
6. Plans, billing & fees
- Free products. PixelIQ is free. CollectionsIQ offers a free tier.
- Paid plans. Paid CollectionsIQ subscriptions are billed through Shopify’s billing system as part of your Shopify invoice. By selecting a paid plan you authorize the recurring charge through Shopify.
- Cancellation & refunds. You can cancel any time by downgrading or uninstalling the app; your plan will not renew for the next period. Because charges are processed by Shopify, billing disputes, proration, and refunds are handled in accordance with Shopify’s billing policies. We do not operate a separate refund program. Fees are exclusive of any taxes, which are handled by Shopify where applicable.
- Price changes. We may change plan pricing prospectively; changes apply from your next billing period and will be reflected on the relevant product page.
7. Acceptable use
You agree not to: (a) use the Services unlawfully or in breach of any third party’s rights; (b) attempt to reverse engineer, interfere with, or disrupt the Services or their security; (c) circumvent usage limits or access the Services other than through the provided interfaces; (d) use the Services to process data you have no right to process; or (e) use the Services to violate the terms of Shopify, Google, Meta, Pinterest, TikTok, or any other connected platform.
8. Third-party services
The Services integrate with third-party platforms — including Shopify, Google (Google Ads API), Meta, Pinterest, TikTok, and the Google Chrome Web Store — each governed by its own terms and policies. Your use of those platforms through EcomIQ is also subject to their terms. We are not responsible for third-party platforms, and their availability or changes may affect the Services. Our use of Google Ads API data complies with the Google API Services User Data Policy, including its Limited Use requirements (see the CollectionsIQ Privacy Policy).
9. Intellectual property
EcomIQ, its software, brand, and content are owned by us or our licensors and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your own business while these Terms are in effect. You retain all rights to your own store data and content; you grant us the limited rights needed to operate the features you enable (see the Privacy Policy).
10. Data & privacy
Our handling of personal data is described in our Privacy Policy and the product-specific policies for CollectionsIQ and PixelIQ. For CollectionsIQ, where we process personal data on your behalf as a processor, those terms also act as our data-processing commitments. You are responsible for having a lawful basis to connect and process the data you bring to the Services.
11. Disclaimers
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, or that any merchandising, demand, or performance outcome will be achieved. Decisions you make using the Services are your responsibility.
12. Limitation of liability
To the fullest extent permitted by law, EcomIQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Services is limited to the greater of (a) the amounts you paid us for the Services in the three (3) months before the event giving rise to the claim, or (b) EUR 100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including, for any user qualifying as a consumer, mandatory statutory rights.
13. Indemnification
You agree to indemnify and hold harmless EcomIQ from claims, losses, and expenses arising out of your use of the Services, your content or data, or your breach of these Terms or of any third-party platform’s terms.
14. Term & termination
These Terms apply while you use the Services. You may stop at any time by uninstalling the app or removing the extension. We may suspend or terminate access if you breach these Terms, if required by a platform or by law, or if we discontinue a product. On termination, the licence granted to you ends; data handling on termination is described in the Privacy Policy and the Data Deletion page. Provisions that by their nature should survive (e.g. intellectual property, disclaimers, liability, governing law) survive termination.
15. Changes to the Services or these Terms
We may update these Terms. We will revise the “last updated” date and, for material changes, provide reasonable notice (in-app, by email, or on this page) before they take effect. Continued use after changes take effect constitutes acceptance.
16. Governing law & disputes
These Terms are governed by the laws of Poland, without regard to conflict-of-laws rules, and the courts competent for the seat of PBF Piotr Białozor-Fiećko have jurisdiction — except where mandatory law (for example, consumer-protection law for any user qualifying as a consumer) grants you the protection of your local courts and laws, which we do not seek to exclude. We are happy to resolve concerns informally first; please contact us.
